Sapora — Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the Sapora platform (the Platform), operated by Sapora ("we", "us", "our").
By creating an account or using the Platform, you agree to be bound by these Terms.
1. Who May Use the Platform
1.1 The Platform is available only to parents or legal guardians who are legally responsible for a child's education.
1.2 The parent or guardian is the account holder and enters into this agreement on their own behalf and on behalf of any child for whom the Platform is used.
1.3 Children do not hold accounts in their own right.
2. Purpose of the Platform
2.1 The Platform provides tools, content, and organisational support to assist parents who are educating their children at home.
2.2 Sapora is not:
- a registered school,
- a correspondence provider,
- a private training establishment,
- or a curriculum authority.
2.3 Parents remain solely responsible for:
- selecting educational content,
- supervising learning activities,
- assessing progress and outcomes, and
- complying with all obligations under the Education and Training Act 2020 and any Ministry of Education requirements relating to home education.
3. Account Registration and Security
3.1 You must provide accurate and current information when registering.
3.2 You are responsible for maintaining the confidentiality of your login credentials.
3.3 You are responsible for all activity carried out through your account.
4. AI-Generated and Assisted Content
4.1 Some content made available through the Platform is generated or assisted by artificial intelligence systems.
4.2 While we take reasonable steps in designing and monitoring the Platform:
- AI-generated content may be incomplete, incorrect, outdated, or inappropriate for a particular learner or context.
4.3 The Platform does not replace parental judgment. You are responsible for reviewing, adapting, and approving all content before using it with a child.
5. Acceptable Use
You agree not to:
- misuse the Platform in a way that breaches any law,
- upload harmful, offensive, or misleading material,
- attempt to interfere with the operation or security of the Platform,
- use the Platform for commercial resale without permission.
We may suspend or terminate access if these Terms are breached.
6. Intellectual Property
6.1 All intellectual property in the Platform, including software, content, design, and branding, is owned by or licensed to Sapora.
6.2 You may use Platform content only for personal home-education purposes and may not reproduce or distribute it without permission.
7. Subscriptions and Fees
7.1 Some features may require payment.
7.2 Subscription terms, pricing, and billing cycles will be clearly disclosed before purchase.
7.3 Fees are non-refundable except where required by New Zealand law.
8. Third-Party Services
8.1 The Platform relies on third-party infrastructure and services (such as AI providers and cloud hosting).
8.2 We are not responsible for outages or failures caused by third-party services beyond our reasonable control.
9. Privacy
9.1 We collect and use personal information in accordance with our Privacy Policy, which forms part of these Terms.
9.2 Parents act on behalf of their children in all data-related matters.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, we exclude all liability for loss or damage arising from use of the Platform.
10.2 Where liability cannot be excluded, it is limited to the total fees paid by you in the 12 months preceding the event giving rise to the claim.
11. Consumer Law
Nothing in these Terms limits rights that cannot be excluded under the Fair Trading Act 1986 or Consumer Guarantees Act 1993.
12. Termination
12.1 You may stop using the Platform at any time.
12.2 We may suspend or terminate access if these Terms are breached.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform indicates acceptance of updated Terms.
14. Governing Law
These Terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction.
